Terms of Service

1. Acceptance of Terms

By accessing or using Insurance.Dental (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a dental practice or organization, you represent that you have authority to bind that entity to these Terms. If you do not agree, do not use the Service.

2. Description of Service

Insurance.Dental provides dental practice revenue intelligence tools, including:

• Fee schedule gap analysis comparing your reimbursement rates to market benchmarks
• Payer scorecards and trend tracking
• Revenue erosion analysis and negotiation briefings
• Enrollment form management and auto-fill capabilities

The Service is an analytical tool. It does not provide legal, financial, or insurance advice.

3. Accounts and Registration

• You must provide accurate practice information during registration
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access
• One account per dental practice location; multi-location practices may request additional accounts

4. Subscription Plans and Billing

• The Service offers Free, Practice, and Group tiers with different feature access
• Paid subscriptions are billed monthly or annually through Stripe
• You may cancel at any time; access continues through the end of your billing period
• We reserve the right to modify pricing with 30 days' notice to existing subscribers
• Refunds are handled on a case-by-case basis

5. Your Data

• You retain full ownership of all claims data, fee schedules, and practice information you upload
• You grant us a limited license to process your data solely to provide the Service
• We do not claim ownership of your data
• You may export or delete your data at any time

6. Market Benchmark Data

• Market benchmarks are derived from publicly available data sources and proprietary analysis
• Benchmark data is provided "as is" for informational purposes
• Percentile rankings and trend data are statistical estimates, not guarantees of payer behavior
• We update benchmarks periodically but do not guarantee real-time accuracy

7. Acceptable Use

You agree not to:

• Upload falsified claims data or misrepresent practice information
• Attempt to reverse-engineer benchmark data to identify other practices
• Use the Service to engage in insurance fraud or misrepresentation to payers
• Share account credentials or allow unauthorized access
• Scrape, crawl, or programmatically extract data from the Service
• Interfere with or disrupt the Service infrastructure

8. Negotiation Briefings

Negotiation briefings generated by the Service are informational tools to support your payer negotiations. They do not constitute legal advice, and we do not guarantee any negotiation outcome. You are solely responsible for your communications and agreements with payers.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT BENCHMARK DATA WILL BE COMPLETELY ACCURATE. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSURANCE.DENTAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Insurance.Dental, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. HIPAA

If your use of the Service involves Protected Health Information as defined by HIPAA, a separate Business Associate Agreement must be executed. Contact legal@insurance.dental to request a BAA.

13. Modifications

We may update these Terms at any time. Material changes will be communicated via email to registered users at least 30 days before taking effect. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Texas.

15. Termination

We may suspend or terminate your access for violation of these Terms. Upon termination, your right to use the Service ceases, and we will delete your data per our Privacy Policy retention schedule.
